  1. The cases above showcase numerous different homeowners bringing strong cases, fighting — and winning — to protect your rights, such as secret ballot voting, proper assessments, lawful violation notices, transparency, and more. Why does the board so persistently attempt to deny your rights?
  2. The board has forced/chosen every litigation listed above by refusing to engage with homeowners, declining to mediate/negotiate, or rejecting zero-cost settlement offers.
  3. The board has never prevailed in any fully adjudicated lawsuit.
  4. The board has spent over $105,000 of homeowner assessments on litigation without recovering a single penny.
  5. Their poor decisions led to the loss of our HOA insurance, causing rates to double and the deductible to skyrocket by 25 times! Despite this, they chose not to utilize the insurance, instead spending approximately $46,000 to fight a $500 risk. Why would anyone make such a reckless choice?
  6. The board persists in pursuing litigation, repeatedly ignoring appeals from numerous members to cease their litigious approach.
  7. In the particularly meritless case initiated at the direction of Kurt Meister, the judge dismissed their lawsuit outright — spontaneously and without either party requesting it — further demonstrating the poor judgment behind the board’s legal strategy.
  8. The board not only believes they have a “community mandate” to litigate rather than settle or negotiate every dispute but also clings to the unrealistic belief that they will win every lawsuit. To date, their track record remains a perfect zero out of 8 completed cases — 6 still open.
  9. “Attorney opinions” and “advice,” funded by your assessment dollars, have consistently driven litigation over resolution, never resulting in a favorable outcome. This pattern highlights a failure in both board leadership and risk management.
  10. Ogden is directly responsible for several of these cases. Their mistakes, legal violations, and poor guidance have repeatedly forced the HOA into costly and unnecessary litigation. Why do we continue to rely on Ogden?
